Employment Class Actions One of the most effective means to adjudicate a large number of claims collectively is through a class action. In order to bring a class action, the representative of the putative class must satisfy a number of conditions. The court must agree that the representative has claims typical of the class and that he or she is an adequate representative to protect the interests of the class. The claims must also have common issues of fact and law. If a court decides that a class action is the most effective mechanism to adjudicate claims, it may very well certify the class. Class actions are extremely effective in wage and hour claims (i.e., overtime violations). Employees in an identifiable class who are not paid correctly can usually bring their claims as a class action because of a uniform pay policy. Once a court certifies a class, employees can typically expect that employers will settle because of the overwhelming fiscal consequences of losing the class action lawsuit.
